Terms of Service

This Service is powered by a.Lab. All rights reserved. Any unauthorized technical analysis, reverse engineering, or imitation of the core logic of this Service is strictly prohibited and protected under applicable intellectual property and trade secret laws, including international IP conventions.

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of autoAdfit, an AI-powered ad creative optimization platform operated by a.Lab ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions

  • Service: The autoAdfit platform and all related features operated by a.Lab.
  • User: Any individual or entity that accesses or uses the Service.
  • Free Member: A User accessing the Service without an active paid subscription.
  • Pro Member: A User with an active paid Pro subscription.
  • Content: Any images, data, or materials uploaded to or processed through the Service.
  • Proprietary Technology: The AI layout engine, processing architecture, prompt design, scoring algorithms, and any other technical systems and trade secrets developed exclusively by a.Lab.

3. Changes to Terms

  1. These Terms take effect upon your use of the Service or acceptance during sign-up.
  2. We reserve the right to modify these Terms at any time, subject to applicable law.
  3. For non-material changes, we will provide at least 7 days' notice via an in-app announcement. For material changes, at least 30 days' notice will be given.
  4. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

4. Description of Service

The Company provides the following features:

  • AI-powered automatic cropping and multi-format optimization of ad images
  • Platform-specific Safe Zone application (Meta, TikTok, YouTube, Google Ads, and more)
  • Batch export of all ad formats in a single ZIP download
  • Brand Kit and creative asset management
  • Any additional features or integrations developed by the Company

Free plan exports include an AutoAdfit | a.Lab watermark. Watermark removal is available exclusively on the Pro plan.

5. User Obligations

You agree not to:

  • Upload images that infringe any third party's copyright, trademark, right of publicity, or other intellectual property rights
  • Upload or distribute illegal, harmful, or otherwise objectionable content
  • Interfere with or disrupt the integrity or performance of the Service
  • Resell, sublicense, or commercially exploit the Service without the Company's prior written consent
  • Send excessive automated requests (scraping, DDoS attacks, or similar)
  • Attempt to reverse-engineer, decompile, or otherwise derive the source code or logic of the Service
  • Use another person's account without authorization

6. Content Ownership & License

  1. You retain all ownership rights to the original images you upload.
  2. By uploading Content, you grant the Company a limited, non-exclusive, worldwide, royalty-free license to process your Content solely for the purpose of delivering the requested Service outputs to you. This license does not extend to training AI models, building derivative datasets, or any use beyond direct Service delivery.
  3. Your Content is never used to train, fine-tune, or improve any AI model — whether operated by us or by any third-party AI provider.
  4. The Company will not sell your Content or disclose it in any personally identifiable form to third parties.
  5. You own all rights to the optimized output generated from your Content through the Service.

7. Data Privacy & Security

7.1 Non-Training Guarantee

We are firmly committed to protecting the privacy of your creative assets. Your uploaded images and generated outputs are never used to train, evaluate, or improve any AI model — including those operated by third-party AI providers integrated into the Service.

  • AI providers receive your Content solely for real-time inference on your specific request.
  • No image, metadata, or derived representation of your Content is retained by AI providers beyond the scope of a single processing call.
  • We do not build, contribute to, or sell datasets derived from user Content.

7.2 Processing Architecture

The Service is designed to minimize exposure of your Content:

  • Uploaded source images are stored on our secure infrastructure only for the duration required to deliver your output — deleted as soon as processing completes on the Free plan, and stored up to 7 days (then automatically deleted) on the Pro plan.
  • Processing occurs inside isolated, single-request execution environments with no cross-user data sharing.
  • Generated output files (SVG, layout JSON) are accessible only to the authenticated account that initiated the request.
  • All data in transit is encrypted via HTTPS (TLS 1.3).

7.3 Data Disclosure

Your Content and personal data will not be sold, rented, or disclosed to any third party for commercial purposes. Disclosure is limited to: (a) trusted infrastructure sub-processors bound by confidentiality agreements; (b) cases where disclosure is required by applicable law or a valid legal order. 8. Intellectual Property & Technical Protection

8.1 Proprietary Technology

The Service is built upon proprietary algorithms, AI prompt engineering, layout scoring logic, and processing architectures developed exclusively by a.Lab. These constitute valuable trade secrets and original works of authorship protected under the Unfair Competition Prevention and Trade Secret Protection Act (부정경쟁방지 및 영업비밀보호에 관한 법률), the Copyright Act of the Republic of Korea, and equivalent international intellectual property laws and treaties.

8.2 Prohibited Technical Activities

The following activities are strictly prohibited and may result in civil and criminal liability:

  • Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, logic, or structure of the Service
  • Analyzing API request/response patterns, prompt structures, or model routing behavior to replicate the Service's core functionality
  • Building a competing product or feature that imitates, replicates, or is substantially derived from the Proprietary Technology of this Service
  • Extracting, scraping, or systematically harvesting data from the Service to train, benchmark, or develop any AI system
  • Sharing, disclosing, or publishing any technical findings derived from unauthorized analysis of the Service

8.3 Enforcement

Violations of this Section will be pursued to the fullest extent permitted by law, including injunctive relief, compensatory and punitive damages, and criminal referral where applicable. We actively monitor for unauthorized technical analysis and reserve the right to immediately terminate access and pursue legal remedies without prior notice.

9. System Integrity & Traffic Management

9.1 Automated Rate Limiting

The Service employs automated rate limiting and traffic analysis to protect system stability and ensure fair access for all users. Requests exceeding plan-based thresholds may be throttled or temporarily blocked without prior notice. These limits are applied equally and without discrimination based on technical criteria only.

9.2 Zero-Tolerance Policy for Misuse

We maintain a zero-tolerance policy toward the following behaviors:

  • Automated scraping, crawling, or harvesting of Service outputs at scale
  • Coordinated abuse across multiple accounts (account farming)
  • Attempts to circumvent usage limits, authentication, or access controls
  • Distributing tools designed to automate or exploit the Service
  • Any activity that degrades Service performance for other users

Accounts found engaging in any of the above may be permanently suspended and reported to relevant authorities without refund of any subscription fees.

10. Payments, Refunds & Subscriptions

  1. Merchant of Record: All financial transactions for the Pro plan are processed by our designated Merchant of Record ("MoR"), which assumes responsibility for payment processing, tax calculation, and invoice issuance. Your purchase receipt will be issued by the MoR.
  2. Taxes: The MoR is responsible for calculating, collecting, and remitting applicable sales tax, VAT, or GST based on your billing location. Displayed prices may be exclusive of applicable taxes, which will be shown at checkout.
  3. Billing Cycle: The Free plan is available at no charge, subject to usage limits. Pro plan pricing is listed on the Plans page and will not change without prior notice. Pro subscriptions renew automatically on a monthly or annual basis until cancelled.
  4. Cancellation: You may cancel at any time through the customer portal. Cancellation stops future billing but does not provide pro-rated refunds for the current period — you retain access to Pro features until the end of the paid period.
  5. Refunds: Given the nature of digital content delivery, subscription fees are generally non-refundable once the Service has been accessed within a billing period, unless otherwise required by applicable consumer protection law. For refund enquiries, contact autoadfit@hotmail.com.

11. Advertising

  1. The Service is supported in part by advertisements displayed to Free Members. Pro Members do not see advertisements.
  2. Advertisements are served by Google AdSense and its third-party ad partners. The Company does not control the specific ads shown and is not responsible for the content, accuracy, or practices of any advertiser.
  3. Your interactions with advertisements are strictly between you and the advertiser. Any terms, warranties, or representations related to such transactions are the sole responsibility of the advertiser.
  4. You agree not to artificially interact with ads, encourage others to do so, or interfere with ad delivery or measurement systems on the Service.
  5. Upgrading to the Pro plan removes all advertising from the Service entirely.

12. Service Availability

The Company may temporarily suspend or limit the Service for system maintenance, infrastructure issues, force majeure events, or policy changes. Planned downtime will be announced in advance via an in-app notice where feasible. Emergency interruptions may be communicated after the fact.

13. Disclaimer of Warranties

  1. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, except as required by applicable law.
  2. The Company is not liable for any service disruptions caused by the User's own actions or third-party factors beyond our reasonable control.
  3. The accuracy and suitability of AI-generated outputs are the User's sole responsibility to evaluate before commercial use.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles.

  1. Good-Faith Negotiation: Before initiating any formal proceeding, both parties agree to attempt resolution through good-faith negotiation for a period of not less than 30 days from written notice of the dispute.
  2. Exclusive Jurisdiction: If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the competent courts located in the Republic of Korea, at the court with jurisdiction over the registered address of a.Lab.
  3. IP Disputes: Notwithstanding the above, the Company reserves the right to seek immediate injunctive or other equitable relief in any competent jurisdiction to protect its intellectual property or trade secrets without prior negotiation.
